Terms of Service

1. Agreement

These Terms are an agreement between you and Xpat LLC, the operator of x/pat ("x/pat", "we", "us") for the x/pat app and xpat.social. By creating an account or using x/pat you accept these Terms and our Privacy Policy. If you don't agree, don't use x/pat.

2. Eligibility and your account

• x/pat is for adults only. You must be at least 18 years old and able to agree to these Terms.
• Give accurate information, including your date of birth. Accounts that belong to anyone under 18 are closed.
• You're responsible for activity on your account and for keeping access to your email or sign-in method secure.

3. Community guidelines

x/pat works because people are real and respectful. You must not post, send or do any of the following:

• Harassment, bullying, threats, hate speech, or content that attacks people for who they are.
• Sexual content involving minors, or any child sexual abuse or exploitation. We report it to the authorities (see Child Safety Standards).
• Nudity or sexually explicit content, or sharing intimate images of anyone without their consent.
• Violence, glorification of self-harm, or content that promotes terrorism.
• Scams, fraud, impersonation, fake spots or reviews, or misleading content.
• Spam, unsolicited advertising, or using x/pat to sell to other users without permission.
• Illegal goods or services, or anything illegal where you or the viewer are.
• Other people's private information (doxxing), or content that infringes someone's copyright, trademark or other rights.
• Attempts to hack, scrape, overload or get around safety features of the service.

4. Moderation, reports and appeals

• Automated checks. Text and photos are checked automatically (by our own filters and by OpenAI's moderation service) before or after they are posted. Flagged content may be blocked, hidden or sent for human review.
• Reporting. Report any post, message, spot or profile in the app, or email hello@xpat.social. We review reports within 24 hours. You can also report content you believe is illegal under the EU Digital Services Act this way; please say which law it breaks and where it is.
• Blocking. You can block any user. Blocked users can't message you or see your content.
• What we may do. Remove content, limit features, suspend or close accounts that break these Terms or the law. We'll tell you what we did and why, unless the law or safety reasons prevent it.
• Appeals. If you think we got it wrong, email hello@xpat.social within 6 months with the content or account concerned. A person will review it.
• Intimate images. Requests to remove intimate images shared without consent are handled within 48 hours of a valid request.

5. Your content

• You own what you post (spots, posts, photos, comments, messages).
• You give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for example, resize photos), display and distribute your content to operate, promote and improve x/pat. The license ends when you delete the content or your account, except for content others have already shared or that we must keep by law.
• You promise you have the rights to what you post and that it doesn't break these Terms or anyone's rights.
• Spot details, ratings and neighborhood information come from users. We don't verify them. Use your own judgment, especially about safety.

6. Partner links

x/pat is free and has no in-app purchases. Some screens show partner links marked "Sponsored" (for example travel insurance, eSIMs, money transfer, accommodation, VPNs). If you sign up through one, we may earn a commission at no extra cost to you. The partner's own terms and privacy policy apply, and we're not responsible for their products, prices or service.

7. Copyright complaints

Send copyright notices to hello@xpat.social with: the work you say is infringed, where the content is in x/pat, your contact details, a statement of good-faith belief that the use is unauthorized, a statement that your notice is accurate and that you are the owner or authorized to act for them, and your signature. We respond to valid notices within 10 business days.

If your content was removed by mistake, you can send a counter-notice with: the removed content and where it was, a statement under penalty of perjury that it was removed by mistake or misidentification, your name, address and phone number, and consent to the jurisdiction of the US federal district court for the district where your address is (or, if you live outside the US, any district where we may be found). We may restore it in 10–14 business days unless the complainant files a court action. We close the accounts of repeat infringers.

8. Deleting your account and termination

You can stop using x/pat and delete your account at any time (Settings → Delete Account, or xpat.social/delete-account). We may suspend or end your access if you break these Terms, if the law requires it, or if we stop offering x/pat. Sections 5 (license for content already shared), 9, 10, 11 and 12 survive.

9. Disclaimers

X/PAT IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We don't promise the service will be uninterrupted or error-free, or that user content is accurate. You are responsible for your safety when meeting people or visiting places you found on x/pat.

10. Limitation of liability

TO THE MAXIMUM EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF X/PAT. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO US$100. Some places don't allow these limits, so they may not apply to you, and nothing here limits rights you have under consumer law that can't be waived.

You agree to indemnify us against claims arising from your content or your breach of these Terms.

11. Governing law and disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. If you live in the EU or UK, you also keep the protection of the mandatory consumer laws of your country and may bring claims in your local courts.

Arbitration (US users). Any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Texas or remotely, at your choice. You and we waive the right to a jury trial and to take part in a class action. Either of us may bring a claim in small claims court instead. You can opt out of arbitration by emailing hello@xpat.social within 30 days of first accepting these Terms.

12. Changes and general terms

We may update these Terms. We'll post the new version here, update the date and, for significant changes, notify you in the app. If you keep using x/pat after changes take effect, you accept them. If any part of these Terms can't be enforced, the rest still applies. These Terms are the whole agreement between you and us about x/pat.

Apple users: these Terms are between you and Xpat LLC, not Apple. Apple isn't responsible for x/pat or its content and has no obligation to provide support for it.
